Le service conseil statutaire et gestion des carrières du CDG 34 prend en charge la préparation des dossiers soumis à l’avis des différentes instances placées auprès du CDG 34 et effectue également la communication des avis qui sont rendus lors des réunions. Chaque instance a un domaine d’intervention et un champ de consultation ciblés. Les Commissions Administratives Paritaires CAP et les conseils de discipline instances primordiales pour le déroulement des carrières Présidée par le président du CDG 34, la CAP examine obligatoirement les décisions qui concerne la carrière des agents à titre individuel l’avancement, la promotion interne, la notation, le détachement, la disponibilité, la mutation, etc. Il existe trois CAP, chacune se réunissant sur les dossiers relevant de sa catégorie A, B ou C. Elle peut être saisie soit à la demande de l’administration, soit à la demande du fonctionnaire à propos d’une révision de notation, d’un refus de démission, d’une autorisation de travail à temps partiel ou d’une autorisation spéciale d’absence pour participer à une formation syndicale. La réunion de ces instances paritaires se déroule une fois par trimestre au CDG 34. Comme la CAP, le conseil de discipline est une instance paritaire et consultative. Il existe un conseil de discipline par catégorie. Présidé par un magistrat de l'ordre administratif, il est composé des représentants titulaires du personnel de la CAP, et des représentants des élus des collectivités affiliées au CDG 34. Les fonctionnaires peuvent engager un recours contre une décision de sanction auprès du conseil de discipline de recours. Cet organisme paritaire, commun à toutes les collectivités et établissements de la région Occitanie, a son siège au CDG 31. Son secrétariat est assuré par les services du CDG 31 CDG31 - Service Comité Technique, Conseils de Discipline et Conseils de Discipline de Recours, Promotion interne 590 rue Buissonnière CS 37666 31676 Labège Tél 05 81 91 93 00 Courriel carrieres Site web Le Comité Technique CT et le Comité d’Hygiène, de Sécurité et des Conditions de Travail CHSCT garants du bon fonctionnement collectif des collectivités Le comité technique est un organisme consultatif qui a pour rôle d’éclairer la prise de décision des collectivités dans les domaines relevant de sa compétence. Un CT est créé dans chaque collectivité ou établissement employant au moins cinquante agents, ainsi qu'auprès de chaque centre de gestion pour les collectivités et établissements affiliés employant moins de cinquante agents. Le CT placé auprès du CDG 34 est composé de 20 membres et autant de suppléants répartis entre les représentants des collectivités territoriales et ceux des fonctionnaires territoriaux. Il se réunit une fois par trimestre. Il est consulté sur les questions d’ordre général et collectif concernant l’organisation et le fonctionnement des services, le plan de formation, le bilan social une fois tous les 2 ans, les conditions de travail et la durée du travail. Il est d’ailleurs obligatoirement consulté sur les mesures de salubrité et de sécurité applicable aux locaux et installations, ainsi que sur les prescriptions concernant la protection sanitaire du personnel. Sur ce dernier sujet, c’est le CHSCT qui est consulté. Il s’agit une structure paritaire ayant une compétence générale sur toutes les questions relatives à l'hygiène, la sécurité et l'amélioration des conditions de travail des agents. Il doit être associé à la recherche de solutions concernant les mesures de salubrité et de sécurité applicables aux locaux et aux installations et doit être consulté sur les prescriptions concernant la protection sanitaire du personnel. Les règles de fonctionnement du CT sont applicables au CHSCT. Ainsi, le CHSCT doit se réunir au minimum deux fois par an sur convocation de son président ou suite à une demande écrite de la moitié des représentants du personnel.
